TERMS AND CONDITIONS OF THE VOLL-DAMM BARBECUE PROMOTION
1. ORGANISER AND PURPOSE OF THE PROMOTION
S.A. DAMM with registered premises at Carrer Roselló, 515, holder of Tax ID No. A08000820, is organising a promotion called "BARBACOA VOLL-DAMM" (hereinafter, the PROMOTION), with the aim of publicising products marketed under the "VOLL-DAMM" brand, owned and registered by S.A. DAMM, and encouraging responsible consumption of these products. This promotion will be subject to the following Legal Terms and Conditions.
2. GEOGRAPHICAL SCOPE OF THE PROMOTION AND ELIGIBLE PARTICIPANTS
The PROMOTION is aimed at end consumers who purchase 18 cans or 18 bottles of Voll-Damm beer and meet the requirements set out in these Terms and Conditions.
Only persons over 18 years of age resident in Spain and Andorra may take part in the PROMOTION.
Any person working for S.A. DAMM and/or its distributors, family members of such persons, and any other person directly or indirectly related to the creation and implementation of the PROMOTION is expressly excluded from this PROMOTION.
Participants who fail to meet any of these requirements, will be automatically disqualified, even if they submit winning entries.
3. DURATION OF THE PROMOTION
The PROMOTION will begin on 1 July 2020 and will end on 31 August 2020.
No entries will be accepted after the above closing date.
4. MECHANISM OF THE PROMOTION AND GIFTS
Participants in the promotion will be able to win 1 of the 100 Weber Q1000 barbecues valued at €299.
In addition, the first 200 participants will be given a chef's apron.
The system for participation is as follows:
Participants must buy a minimum of 18 cans or 18 bottles of Voll-Damm beer, which are included in a single receipt, keep the receipt and then access the www.barbacoavolldamm.com website, where they must correctly complete the registration form with their personal details (full name, e-mail, country, province and postcode) and upload the receipt. This must be done between 1 July and 31 August 2020, both inclusive.
The image of the receipt must show the date of purchase, the item(s) purchased and the price of the product included in this promotion. Each receipt entitles the holder to only one entry. Users can participate as many times as they wish, provided that the receipts uploaded for each entry are different.
If the moment (minute, hour and day) at which a participant submits an entry coincides with any of the 100 "winning moments", or is closest to such a moment, said participant will be notified that he/she is a winner within 72 hours, once all the details of the entry are verified. If an entry is not valid, the prize will be assigned to the next valid entry registered.
The time of an entry will be the moment when the participant clicks the "Participate" button, after completing the registration form on the www.barbacoavolldamm.com website and uploading a receipt that meets the requirements of the promotion.
The winners will be contacted via the e-mail provided, so that they can specify the address to which the prize should be sent.
S.A. DAMM reserves the right to request the original receipt uploaded at the time of registration. If the receipt has been tampered with, is a photocopy, has been lost, or has been used to participate in other promotions that S.A. DAMM may organise at the same time as this promotion, or fails to meet any of the requirements specified in these Terms and Conditions, the user will not be entitled to the prize.
5. RESPONSIBILITIES
S.A. DAMM is not responsible for incidents or events of any kind caused by malfunctions of the computer program due to force majeure (e.g., a user's inability to register, interruption or loss of a call, etc.) or incidents of force majeure arising from causes such as breakdowns in telephone, computer and electricity networks, due to natural factors such as atmospheric or climate conditions, or failure to provide these services by the companies operating them.
S.A. DAMM is not responsible if it is impossible for a user to register because of an error in the capture of their personal data, as a result of any documents that are illegible, incomplete, erroneous or false, such as receipts which are illegible or do not allow the information required by the terms of the promotion to be correctly recorded.

7. PERSONAL DATA PROTECTION
By means of the promotional mechanism described, and in compliance with applicable legislation, participants in the promotion are informed that their details will be processed by S.A. DAMM in order to manage the promotion and assign prizes to the corresponding winners.
By completing the promotion form, the participant expressly agrees to the use of his/her personal data to manage the promotion, attend to users and provide the services requested, in accordance with the information provided when users register for the promotion, regarding the purpose and legal basis of using their data and the recipients of said data.
Fields marked with an asterisk in the form referred to in the Mechanism of the Promotion are strictly necessary for users to participate in the promotion, and for it to be correctly managed.
Participants in this promotion may exercise their rights to access, rectify, delete and transfer their data, and to limit or oppose their use by writing to the following postal address: S.A. 8. RESERVATIONS AND LIMITATIONS
S.A. DAMM reserves the right to cancel this PROMOTION or suspend it, or to change some of its conditions if, for technical reasons or reasons of any other kind beyond its control, it cannot proceed normally with the Promotion, as specified in these Terms and Conditions.
S.A. DAMM may also declare this PROMOTION invalid if it detects irregularities in users’ identification data.
S.A. DAMM is not responsible for the veracity of the data provided by users.
S.A. DAMM reserves the right to justifiably delete any user who commits fraud, or alters or impedes the proper normal legal functioning of this PROMOTION.
9. APPLICABLE LAW AND JURISDICTION
The promotions of S.A. DAMM are governed by current Spanish legislation.
For any disagreement that may arise in the interpretation and application of these Terms and Conditions, both S.A. DAMM and the participants in this PROMOTION agree to be bound by the authority of the relevant Courts and Tribunals.
S.A. DAMM reserves the right to take legal action against any person engaging in any type of activity that may be considered manipulation or falsification of the PROMOTION.
10. ACCEPTANCE OF TERMS AND CONDITIONS
Potential participants are hereby informed that the mere fact of taking part in the PROMOTION implies full acceptance of these Terms and Conditions. The participant's refusal to accept them implies the exclusion of the participant from the PROMOTION and S.A. DAMM will be released from any obligation contracted with the participant.
The Terms and Conditions of this PROMOTION have been lodged with Don Jose-Alberto Marín Sánchez, Notary of the Official College of Barcelona, at Carrer Diputació, 268 (entresol), and are freely available to consumers in the Ábaco register (Notarial Register of Terms and Conditions Governing Competitions).
